Before Magistrate Richard Vander Mey:

The case of Meskwaki Nation Tribal Police concerning a charge of possession of controlled substance against a 54-year-old Des Monies person was dismissed. The court ruled, “The Defendant appears for preliminary hearing. No witnesses for the prosecution appear. The undersigned has reviewed the citation and notes that the Defendant was not charged with possessing any particular controlled substance but is charged with possessing a “controlled substance.” This is seriously deficient and does not give the Court any basis for proceeding forward with the case. This case is dismissed. Costs are taxed to the Meskwaki Nation.” The complaint field by Meskwaki Nation Tribal Police alleged video footage showed “the defendant putting a tissue in his pocket and then in the garbage. We located a controlled substance in a tissue. The tissue was found in the garbage.” The action took place at 8:52 p.m. on Jan. 20 according to the citation.
